Patent Infringement | " RIM Ordered to Pay $147M For Patent Infringement"

It appears that dice are loaded against RIM, the famous Blackberry maker. One after another, problems and controversies are cropping up from everywhere, making things more difficult for RIM. According to a latest report, a jury comprising of 8 members from Northern California based district court of US has held ‘Research in Motion’ guilty for causing a damage of $147.2 million to Mformation Technologies by violating the patent rights possessed by Mformation Technologies.

This verdict came on Friday and as an outcome, RIM will have to compensate for violating the patent rights regarding software called ‘Blackberry Enterprise Server’ by RIM. This software basically facilitates companies in managing remote devices of their employees. RIM will have to shell out $8 for every 18.4 million units that are being sold.

Mformation held RIM liable for breaching two of its patents, way back in 2008 when Mformation made a short presentation about its technology and RIM refused to permit license for the same during that time. Subsequently, in order to adapt that specific technology possessed by Mformation, RIM made some amendments into its software.

Pointless to say that this Friday verdict came as a major blow for RIM as this Ontario based Blackberry maker is already struggling for gaining a strong foothold in the market. RIM has decided to search out ways in order to come out from this new trouble. According to a RIM’s spokesperson, this verdict is unfair as RIM does possess an impressive portfolio of intellectual property rights and considering the fact that RIM is quite self-reliant in building up cutting edge technology, it is difficult to understand how can any company accuse RIM for infringing patents.

RIM’s reaction to this verdict is quite predictable because RIM dealings have always been above board and the company has always kept ill-gotten gains at bay. On the other side, Mformation is in ecstatic mood and expressed its gratefulness towards the decision of Jury because this is one of the most significant software possessed by Mformation which holds a strategic importance due to its radical mobile phone management technology.

Rakesh Kushwaha (Mformation founder and CTO) stated that after receiving a favorable verdict concerning 27 patent rights, he is confident about company’s Intellectual property rights portfolio which will give his company a leading edge in mobile phone management market.

For RIM, it is certainly another major disappointment after witnessing a poor fiscal quarter performance and 9 year low stock slump. By delaying up the release of its most promising next-gen Blackberry handsets, RIM decided to play for time in the hope that this delay will give sufficient time to Blackberry developer’s team in developing the best BB 10 model so far. Delaying BB 10 devices will also give RIM enough time regarding chalking out the best strategies related to selling devices, developing strong and friendly relations with developers and carriers, marketing aspect, etc.

Well, looking at RIM, one can say that this is what we call a perfect example of Catch-22 situation. The existing situation of RIM seems to deteriorate with every single passing day and no one has any clue when RIM would be able to sort out everything and make an impressive comeback.
